EU261 in brief

EU Regulation 261/2004 gives passengers the right to €250–€600 compensation for delays of 3+ hours at arrival, cancellations, or denied boarding — unless there was an extraordinary circumstance such as severe weather.

📋

When do you qualify?

  • Arrival delay of 3+ hours
  • Flight cancelled with less than 14 days' notice
  • Denied boarding (overbooking)
  • Extraordinary circumstances (ATC strike, severe weather)
  • Claim expired (past the limitation period)

Don't miss the deadline

In the Netherlands, your claim expires 2 years after the flight date. Belgian law is even stricter: 1 year. Other countries vary. Don't wait too long.

How much compensation?

The amount is determined by flight distance, not ticket price.

Short distance

€250 per person

Flights up to 1,500 km
e.g. Amsterdam – London

  • Delay of 3+ hours at arrival
  • Or flight cancelled
  • Or boarding denied
You receive: €250 − €63 fee = €187

Long distance

€600 per person

Over 3,500 km
e.g. Amsterdam – New York

  • Delay of 4+ hours at arrival
  • Or flight cancelled
  • Or boarding denied
You receive: €600 − €150 fee = €450

Common questions

Yes, absolutely. You have the right to submit your EU261 claim directly to the airline yourself, at no cost. DelayPaid takes that work off your hands: we know the procedures, track deadlines, and escalate to court if necessary. That costs you 25% of the compensation paid out — nothing if we win nothing.
EU Regulation 261/2004 applies if your flight departed from any EU/EEA airport, or if an EU-based airline operated a flight arriving at an EU/EEA airport. A flight from New York to Amsterdam with KLM (NL) is covered; the same route with Delta (US) is not.
Most airlines respond within 4–8 weeks. If an airline refuses or doesn't respond, we start court proceedings (Dutch cantonal court), which can take 6–12 months. We keep you updated throughout.
We don't stop at a refusal. We send a formal demand letter. If that doesn't work, we go to court. All escalation costs are covered by us. You only pay our fee if we ultimately succeed.
The limitation period depends on the country. In the Netherlands: 2 years. Belgium: only 1 year (art. X.49 WER — the shortest in the EU). Germany: 3 years. France and Spain: 5 years. Italy: 2 years (safe working deadline). Don't wait too long — once the time limit has passed, the claim cannot be pursued.
A power of attorney authorises us to act on your behalf: submitting the claim, negotiating with the airline, and taking the matter to court if necessary. Your claim remains yours — we are your representative, not the owner of your claim. The power of attorney covers only this specific flight.
